Punjab Government Clarifies Surety Deposit Procedure for Motor Vehicle Dealerships

The Government of Punjab, Department of Transport, issued a notification on January 16, 2024, bearing number 10/14/2022-1T2/62, to partially amend its principal notification concerning motor vehicle dealerships. This amendment, published in the Punjab Government Gazette as an extraordinary publication, came into force immediately upon its issuance. The modification was made in pursuance of advice rendered by the Government of Punjab, Department of Finance, specifically from its Finance Budget-2 Branch, through a letter dated January 2, 2024. The principal notification, numbered 10/14/2022-1T2/705 and dated July 12, 2022, had previously been amended on October 18, 2023, by notification number 10/14/2022-1T2/1782. The latest amendment primarily clarifies the specific financial head under which interest-free surety amounts are to be deposited by various motor vehicle dealers, affecting two-wheeler, four-wheeler, tractor, and self-propelled combine harvester and tractor-driven combine dealerships across the state.

The legislative intent behind this notification is to enhance clarity and streamline the financial procedures related to the deposit of surety amounts by motor vehicle dealers. The earlier legal position, as outlined in para 6 of the principal notification, mandated dealers to deposit an interest-free surety without explicitly specifying the exact receipt head for these funds. This amendment addresses that statutory gap by providing precise instructions for the accounting of these deposits. The legislation provided: “The dealer shall have to deposit a sum of amount mentioned below interest free, as surety, in receipt head 0041 "Taxes on Vehicles" of Transport Department”. This substitution ensures that the surety amounts, which range from Rs. 1,00,000 for two-wheeler, tractor, and combine harvester dealerships to Rs. 5,00,000 for four-wheeler dealerships, are correctly categorized and accounted for within the Transport Department's financial records. This measure aims to improve transparency and administrative efficiency in the collection and management of these refundable deposits, which are a prerequisite for obtaining and maintaining motor vehicle dealership licenses. The amendment does not alter the required surety amounts but rather specifies the procedural aspect of their deposit, thereby reinforcing the existing regulatory framework for vehicle dealerships in Punjab.
